Evenflo has agreed to a $3.5 million class action settlement to resolve allegations that it misrepresented the safety and testing of its “Big Kid” booster seats. The class action lawsuit claims Evenflo falsely advertised the seats as safe for children weighing as little as 30 pounds and labeled them as “side impact tested” without adequate standards or transparency around the testing.
The plaintiffs argued that parents would not have purchased these seats had they known the testing was not regulated and that lower-weight children were at risk when moved to a booster seat prematurely. The case raised questions about the safety marketing of child restraint systems and Evenflo’s responsibility to accurately inform consumers.
Evenflo denies the allegations but agreed to the settlement to avoid further litigation.
Class members can submit a claim for up to two booster seats and choose between two benefit options:
Cash Payment: A pro rata share of the $3.5 million settlement for each claimed booster seat. Exact amounts will depend on the total number of claims filed.
Evenflo Product Credit: A $25 voucher per seat claimed, redeemable on Evenflo’s website for qualifying products.
In addition to financial compensation, Evenflo will make changes to how it markets its booster seats. These include:
Updating the stated minimum weight requirements on “Big Kid” seat packaging.
Posting an educational video to explain how and when to transition a child from a car seat to a booster.
Aligning product labeling with guidance from the National Highway Traffic Safety Administration (NHTSA).
This settlement is part of ongoing efforts to improve transparency and child safety in the car seat industry.
